The Hummingbird Funding website (the “Site”) is comprised of various web pages operated by Hummingbird Funding LLC and is located at www.hummingbirdfunding.com. Use of www.hummingbirdfunding.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference. These Terms are governing for all services and products provided by Hummingbird Funding.

Electronic Communications

Logging onto  www.hummingbirdfunding.com or sending emails to Hummingbird Funding is defined as electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications Hummingbird Funding will provide to you electronically.

Funded Account Terms

Funded accounts are subject to 1:100 FOREX leverage as is industry standard for live accounts. All other instrument leverages are subject to Hummingbird Funding’s discretion and what is deemed reasonable Hummingbird Funding’s risk management policies

International Users

Service is operated and administered by Hummingbird Funding from our offices in Wyoming. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws.

Breach of these Terms or laws in any way may lead to immediate termination of all accounts associated with our services, and no refund or payment of any kind shall be issued. In addition, you may be held civilly and/or criminally liable if you are in breach of these Terms and relevant laws.  

Indemnification

You agree to indemnify, defend and hold harmless Hummingbird Funding, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations..

Termination/Access Restriction

Hummingbird Funding reserves the right, to terminate your access to the Site and the related services or any portion at any time, without notice. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

Changes to Terms

Hummingbird Funding reserves the right, in its sole discretion, to change the Terms under which www.hummingbirdfunding.com is offered. The most current version of the Terms will trump all previous versions.
